TRUSTEE LOCAL PRESENCE PARTNER AGREEMENT
This Partner Agreement (“Agreement”) is entered into between Active Data Norge / ADATA.NO – LocalPresence.NO (“ADATA”) and the professional domain provider, registrar, reseller or bulk customer (“Partner”) using ADATA’s Trustee / Local Presence services for Norwegian .NO domain names.
1. SERVICE & PARTNERSHIP
ADATA provides the Partner with Trustee / Local Presence services for registration, renewal, transfer and administration of .NO domain names. ADATA may act as both the Norwegian local presence and registrar, or solely as the Trustee / Local Presence provider where the Partner uses its own or another external registrar.
The same terms, responsibilities and restrictions regarding the use of ADATA’s Norwegian organisation numbers apply regardless of which registrar manages the domain names.
All registrations and services are subject to the applicable rules of Norid, Norwegian law and ADATA / LocalPresence terms. The Partner and its customers receive the right to use domains registered through the Trustee / Local Presence service but acquire no ownership or independent rights to ADATA’s trustee organisations, organisation numbers or Local Presence infrastructure.
2. PARTNER RESPONSIBILITIES & USE OF ORGANISATION NUMBERS
The Partner is responsible for its customers, domain names and use of the domains and shall ensure that all information supplied to ADATA is correct and current.
This responsibility also applies to Trustee-only customers using their own or third-party registrars. Any use of an organisation number supplied by ADATA / LocalPresence must be expressly authorised by ADATA and may only be used for domains covered by an active Trustee / Local Presence agreement.
The organisation number may not be transferred, shared, reused or used to register additional domains outside the agreed service without prior written approval from ADATA.
The Partner shall ensure that its customers comply with Norid rules, Norwegian law and applicable ADATA / LocalPresence terms. Any legal complaint, domain-name dispute, abuse matter or other claim relating to a domain must be communicated to ADATA without unnecessary delay.
The Partner may resell the Trustee / Local Presence service to its own customers where agreed with ADATA, but ADATA’s Norwegian organisation numbers or trustee identities may not be disclosed or made available for independent use by the Partner or its customers.
3. PRICING, RENEWAL & DOMAIN MANAGEMENT
Partner pricing for registrations, renewals, transfers and Trustee / Local Presence services shall be agreed separately based on volume.
Invoices must be paid within the agreed payment terms. Unless otherwise agreed, services are renewed annually. The Partner is responsible for informing ADATA in due time of domains that shall not be renewed.
Domains may only be transferred, sold or moved to another registrar or domain holder in accordance with Norid requirements and ADATA procedures. Where necessary, the Partner must provide a valid new Norwegian holder or organisation number before a domain can leave ADATA’s Trustee / Local Presence service.
4. COMPLIANCE, TERMS, LIABILITY & TERMINATION
ADATA may suspend or terminate services for domains that violate Norid rules, Norwegian law, this Agreement or applicable ADATA / LocalPresence terms, including cases of unauthorised use of ADATA organisation numbers, non-payment, abuse or legal disputes.
ADATA shall not be liable for interruptions or losses caused by registry actions, third-party registrars or suppliers, technical incidents, changes in laws or registry policies, force majeure or circumstances outside ADATA’s reasonable control.
Both parties shall handle customer and business information confidentially and in accordance with applicable GDPR requirements.
In addition to this Partner Agreement, the Partner confirms that it has read, understood and accepted the applicable terms and conditions available at:
